1. Acceptance of Terms

By creating an account, accessing, or using Twidii, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using the Services on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Eligibility

To use Twidii, you must:

• Be at least 13 years of age
• If you are between 13 and 18 years old, have permission from a parent or legal guardian
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Services under applicable law
• Not have been previously banned from our Services

3. Account Registration

3.1 Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as needed
• Keep your password secure and confidential
• Not share your account credentials with others
• Notify us immediately of any unauthorized access

3.2 Account Responsibility

You are responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Services Description

Twidii provides a platform that allows users to:

• Create and record short-form video content
• Upload and manage multimedia content
• Connect third-party social media accounts
• Cross-post content to multiple social media platforms
• Interact with other users through likes, comments, and follows

5. User Content

5.1 Your Content

"User Content" includes all content you create, upload, post, or share through our Services, including videos, images, text, captions, and other materials.

5.2 Ownership

You retain ownership of your User Content. However, by posting User Content on Twidii, you grant us a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, distribute, display, and perform your User Content in connection with operating and providing our Services.

5.3 Content Representations

By posting User Content, you represent and warrant that:

• You own or have the necessary rights to the content
• Your content does not infringe any third-party rights
• Your content complies with these Terms and applicable laws
• You have obtained necessary permissions from individuals appearing in your content

6. Prohibited Content and Conduct

You agree NOT to post, upload, or share content that:

• Is illegal, harmful, threatening, abusive, harassing, or defamatory
• Contains nudity, pornography, or sexually explicit material
• Promotes violence, terrorism, or hate speech
• Infringes copyrights, trademarks, or other intellectual property rights
• Contains malware, viruses, or harmful code
• Is spam, fraudulent, or misleading
• Violates the privacy of others
• Exploits or harms minors in any way
• Impersonates another person or entity
• Violates any applicable law or regulation

You also agree NOT to:

• Use automated systems or bots to access the Services
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services
• Collect user information without consent
• Use the Services for commercial purposes without authorization
• Circumvent any technical measures we use to provide the Services

7. Third-Party Services and Platforms

7.1 Social Media Integration

Twidii allows you to connect third-party social media accounts (such as YouTube, TikTok, Instagram, Pinterest, Twitter/X, and Snapchat). When you connect these accounts:

• You authorize us to access and post content on your behalf
• You agree to comply with each platform's terms of service
• You understand that we are not responsible for those platforms' actions
• You may disconnect these accounts at any time

7.2 Third-Party Terms

Your use of connected platforms is governed by their respective terms of service. We are not responsible for content posted to third-party platforms or their handling of your data.

8. Intellectual Property

8.1 Our Intellectual Property

The Twidii name, logo, app design, features, and all related intellectual property are owned by us and protected by copyright, trademark, and other laws. You may not use our intellectual property without prior written consent.

8.2 Copyright Infringement

We respect intellectual property rights. If you believe your copyrighted work has been infringed, please contact us at twidiiapp@gmail.com with:

• Description of the copyrighted work
• Location of the infringing content
• Your contact information
• A statement of good faith belief
• A statement of accuracy under penalty of perjury
• Your physical or electronic signature

9. Termination

9.1 Termination by You

You may delete your account at any time through the App settings. Upon deletion, your account and associated data will be removed according to our Privacy Policy.

9.2 Termination by Us

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your account poses a security risk
• We are required to do so by law
• We discontinue the Services

9.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and dispute resolution.

10. Disclaimers

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• Results obtained from the Services will be accurate or reliable
• Any errors will be corrected
• The Services will meet your expectations

11. Limitation of Liability

Our total liability for any claim arising from these Terms or the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify, defend, and hold harmless Twidii, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Services
• Your User Content
• Your violation of these Terms
• Your violation of any third-party rights

13. Dispute Resolution

13.1 Informal Resolution

Before filing any formal dispute, you agree to first contact us at twidiiapp@gmail.com to attempt to resolve the dispute informally.

13.2 Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13.3 Arbitration

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration, except where prohibited by law. You agree to waive the right to participate in class actions.

14. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

• Posting the updated Terms in the App
• Updating the "Last Updated" date
• Sending you a notification for significant changes

Your continued use of the Services after changes constitutes acceptance of the modified Terms.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Twidii regarding the Services.

15.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

15.3 No Waiver

Our failure to enforce any provision of these Terms shall not be deemed a waiver of that provision or our right to enforce it later.

15.4 Assignment

You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.

15.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control.

By using Twidii, you acknowledge that you have read and understood these Terms of Service and agree to be bound by them.
